Describe a situation of sex discrimination based on equal pay in the workplace that you have witnessed on one that you have heard about in the news. How would you handle that situation if it happened to you?
I would like to talk about my daughter who is pregnant, she was working for Dairy Queen and was supposely getting paid $17 a hour and was not getting that amount when she got her first pay check. Then they wanted her to reach above her head to bring down boxes after she told them that the doctor did not want her to reach high because of her baby that she is caring. It was a health issue with her that she had to be careful of what she did. So, the manager told her that she know other pregnant women would had did the work that she was supposed to do and they handle it without thinking about it twice. Well my daughter kept telling her what her daughter had told her and showed her the paperwork from the doctor but, the manager did not want to hear what she had to say. So, my daughter just walked off the job and just left them without any help at the workplace. I was just two people working at this Dairy Queen and my daughter was doing all the work that a manager should had done with less pay.
If this had happen to me I would had to the manager that was above her and explain the situation to keep my job. I would not had walked off the job without talking to the owner of that company and letting her know about the doctor's rules for me while I was pregnant on that job. And if I am not suppose to lift heavy boxes up they should had gave me another easy task to do instead of having an attitude toward me.
In our M.U.S.E. under "Equal Employment and the Law" says that: "The pregnancy Discrimination Act of 1978 makes it illegal to discharge or not to hire a woman because she is prenant. Under this Act, it is illegal to deny sick leave for morning sickness or related pregnancy illnesses, and pregnancy must receive the same benefits accorded other illnesses or disabilities." The Equal Pay Act of 1963 prohibits discrimination in pay based upon a worker's gender. The final result of this Act requires equal pay for males and females in jobs requiring equal skill, effort, and responsibility under similar working conditions.
I am not aware of a situation in the workplace that involved sex discrimination based on equal pay. A situation I heard about in the news is a suit against Disney brought by women who stated their male counterparts were being paid more than them for the same job. Ten employees of the Walt Disney company in California are suing for what they are calling “rampant gender pay discrimination”.
In April of 2019 two female employees filed a lawsuit claiming that Disney discriminates against female workers by paying them less than their male counterparts. Eight more current and former female Disney employees have now joined the case. They are suing for back pay, lost benefits, and other compensation. They also want a judge to force Disney to create internal programs to “remedy the effects of Disney’s past and present unlawful employment policies,” including adjusting salaries and benefits for other women and creating a task force that reports on the progress.
Several of the plaintiffs say that they have been performing work associated with more highly compensated positions, but that Disney insisted that promotions could occur only along a ladder — from manager to senior manager and then to director. They stated men in the company were sometimes allowed to skip a step. When one of the plaintiff’s inquired about this unequal treatment, she was told that Disney considered one of the promoted males as more of a ‘retention risk’ because he was younger than her.
If I found myself in the same situation, I would first go to HR to discuss the issue. If I was told by HR that they were not going to do anything about this I would involve others in the workplace to see how they felt about it and file a lawsuit.
